These Terms of Service (“Terms”) govern your use of nwidining.com and portal.nwidining.com (the “Services”), operated by NWI Dining (“we,” “us”). By using the Services or creating an account, you agree to these Terms and to our Privacy Policy.
NWI Dining is a Northwest Indiana restaurant directory. Listings are compiled from public sources and from information submitted by restaurant owners. We strive for accuracy but do not warrant that any listing (hours, menu, pricing, availability, ratings, or status) is complete, current, or error-free. Verify details directly with the restaurant before relying on them.
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Restaurant-owner accounts may only be used to manage listings you are authorized to represent. We may suspend or terminate accounts that violate these Terms.
Some restaurants offer ordering, reservations, waitlist, or deposits through the Services. Those transactions are between you and the restaurant; the restaurant is responsible for fulfilling them. Payments may be processed by third-party processors and/or the restaurant’s own merchant account. We are not the seller of food or goods.
You retain ownership of content you submit (e.g., reviews, listing details, photos) and grant us a non-exclusive, royalty-free license to host, display, and distribute it within the Services. Do not post unlawful, infringing, deceptive, or abusive content. We may remove content at our discretion.
Do not misuse the Services, including by scraping at scale, attempting to breach security, interfering with operation, impersonating others, or using the Services to violate any law.
Listings may include data and imagery from third parties (including Google). Such content belongs to its owners and is provided for informational purposes; rights holders may request removal. The Services may link to third-party sites we do not control.
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, NWI Dining and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our aggregate liability will not exceed the amount you paid us in the twelve months preceding the claim (or USD $100 if you paid nothing).
You agree to indemnify NWI Dining against claims arising from your content, your use of the Services, or your violation of these Terms or applicable law.
We may modify these Terms or the Services at any time; continued use after changes constitutes acceptance. We may suspend or terminate access for any reason, including violation of these Terms.
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Indiana, except where prohibited by law.
